Challenge Jurisdiction Specifically: In Personam and Subject-Matter

Men challenges the judge’s/court’s jurisdiction the right way by being SPECIFIC: (1) in personam jurisdiction and (2) subject-matter jurisdiction. Whereas, the courts DO have jurisdiction to review jurisdiction. Get it? Must say (1) and (2)

in personam – literally translating to “against the person,” refers to courts’ power to adjudicate matters directed against a party. A court may exercise in personam jurisdiction over a person who resides in, maintains connections with, or is served notice of legal proceedings in that court’s area of territorial jurisdiction.

Subject matter jurisdiction is the power of a court to adjudicate a particular type of matter and provide the remedy demanded. law.cornell.edu/wex/subject_ma…

Jurisdiction may be broken down into two categories: personal jurisdiction and subject matter jurisdiction. While personal jurisdiction governs where the parties may be heard, subject matter jurisdiction governs what the court can hear specifically.

“While litigating parties may waive personal jurisdiction, they cannot waive subject-matter jurisdiction”
