The irony is that the IRS is in no position to challenge “nonresident alien” status anyway, so it doesn’t matter how you arrived at that status provided you have a reasonable basis. The maxim of law that one cannot be compelled into a contract is sufficient basis, since the benefits and obligations of the “United States person” tax status definitely describe a contract.
